Terms and conditions

This is a translation of the Romanian original, provided for convenience. It has not been reviewed by a legal translator.

1. Who we are

themarketlab.cloud is operated by Cătălin Hotca. Contact: office@themarketlab.cloud, 0743 621 760.

In this document, "we" means Cătălin Hotca, and "you" means anyone who accesses the site or buys the products presented on it.

2. Accepting these terms

By using the site you accept these terms. If you do not agree with them, please do not use the site.

The site is addressed exclusively to persons over 18.

3. What we sell and how

We sell digital content: an ebook in electronic format, delivered through a download link immediately after payment. We also present links to partner trading platforms, marked as such.

The sale is made through Lemon Squeezy. The platform, operated by Sold through Link, LLC (Statele Unite), acts as Merchant of Record: it is the registered seller to you, it processes the payment, issues the invoice and applies the taxes due in your country. The contract of sale is concluded between you and that entity; we are the author and the holder of the rights in the content. Therefore:

The price shown on the site is the one valid at the time of the order. The final price, including the taxes applicable in your country, is shown at checkout, before payment.

We reserve the right to change prices at any time. A change does not affect orders already paid.

4. Delivery

The ebook is delivered electronically, through a download link sent to the email address used for the order, immediately after the payment is confirmed. Nothing physical is delivered and there are no shipping costs.

If you have not received the email within 30 minutes of payment, check your Spam folder, then write to us at office@themarketlab.cloud and we will resend the link.

5. The order is final. No returns

The ebook is digital content, delivered immediately after payment. Once downloaded, it stays with you — a file cannot be returned. For this reason the law provides an express exception to the 14-day right of withdrawal: Art. 16(m) of Romanian Government Emergency Ordinance no. 34/2014.

At checkout you tick two separate things: that you agree delivery may begin immediately, and that you understand you thereby lose your right of withdrawal. With those two confirmations, the order becomes final and the price is not refunded.

We do not refund because: you changed your mind, you did not have time to read the material, you felt you already knew the content, or your trading results are not what you expected.

The only two situations in which you get your money back:

  1. The product does not conform (Romanian GEO no. 141/2021): the file does not download, is damaged, or does not contain what we described on the sales page. Write to us at office@themarketlab.cloud; we fix it — we resend the link, we replace the file — and if we cannot fix it within a reasonable time, we refund in full. This right is yours by law and cannot be removed by these terms.
  2. Double payment, through a technical error or yours: we refund the second payment.

Lemon Squeezy, as the registered seller, has its own refund policy and may decide independently on a request; such a decision belongs to the platform, not to us.

6. How you may use the ebook

Once purchased, you receive a personal, non-exclusive, non-transferable licence, unlimited in time, to read and use the ebook for your own purposes.

You may not: distribute, share, upload to other sites, resell, rent out or make public the file or significant parts of it; translate it, republish it or create derivative products from it; remove the identifying elements or the markings from the file.

All the content of the site and of the ebook — text, structure, graphics, examples, strategies, templates, logo, the name The Market Lab — belongs to us and is protected by Romanian Law no. 8/1996 on copyright. You may quote short excerpts, with attribution.

Breaking these rules ends the licence, without refund, and may give rise to civil and criminal liability.

7. Educational content, not investment advice

This is the most important point in this document.

Everything we publish — ebook, articles, videos, messages in the group — is for educational and informational purposes only. It is not investment advice, a personal recommendation, an offer to buy or sell any financial instrument, and it is not an investment service within the meaning of Romanian Law no. 126/2018.

Cătălin Hotca is not authorised and is not supervised by the Romanian Financial Supervisory Authority (ASF), does not manage client accounts or funds, and does not execute orders on anyone's behalf.

Trading the financial markets, including through prop trading accounts, carries a high risk of losing your capital. Most participants lose money. Past results, ours or anyone else's, do not guarantee future results. Any example, figure or case study in our material is illustrative, not a promise.

We guarantee you no financial result. Trading decisions are entirely yours, at your own risk, and we encourage you to consult an authorised professional before committing real money.

Some links to trading platforms or prop trading firms are affiliate links: if you open an account through them, we receive a commission from the partner, at no extra cost to you. We mark every such link, visibly, next to the link. The list of partners is on the affiliate disclosure page.

The commission does not influence the educational content. We do not recommend and do not guarantee the partners’ services; the contractual relationship you enter into with them does not involve us, and disputes with them are settled directly between you.

Always check for yourself the terms, the reputation and the regulatory status of any firm before you send it money.

9. Your conduct on the site

You may not attempt unauthorised access to the site or our systems, subject it to attacks or artificial load, extract content automatically (scraping) without our written agreement, or use it for unlawful purposes.

10. Availability and changes

We make reasonable efforts to keep the site available, but we do not guarantee it uninterrupted or error-free. We may suspend access temporarily for maintenance and we may change or withdraw content at any time.

We may change these terms. The version in force is the one published on this page, with the date and version shown at the top. Changes apply from publication and do not affect orders already paid. For significant changes, we announce them on the site and by email to subscribers.

11. Liability

To the extent permitted by law, we are not liable for financial losses resulting from your trading decisions, for indirect losses or loss of profit, or for the temporary unavailability of the site.

Nothing in these terms limits liability that cannot be limited by law, including liability for damage caused intentionally or through gross negligence, and your statutory consumer rights.

12. Complaints, applicable law, disputes

Any complaint is first sent to office@themarketlab.cloud. We reply within 30 days.

If we do not reach a solution, you may address the Romanian National Authority for Consumer Protection (anpc.ro) or use the national alternative dispute resolution platform, at reclamatiisal.anpc.ro.

These terms are governed by Romanian law. Disputes are settled by the competent courts in Romania. If you are a consumer domiciled in another European Union state, you keep the right to bring proceedings before the courts of your domicile and you benefit from the mandatory consumer protection rules of your state.

13. Miscellaneous

If a clause in this document becomes void or unenforceable, the rest remains in force.

The fact that we do not immediately invoke a right does not mean we waive it.

The Romanian version of these terms prevails in case of any discrepancy with the translations.
